These Terms and Conditions (“Terms”) govern your access to and use of sleepinglab.my (“Website”) and the products and services provided by Listening Lab Sdn Bhd, operating the Sleeping Lab brand in Malaysia (“Sleeping Lab”, “we”, “us” or “our”).

By accessing our Website, submitting an enquiry, booking an appointment, purchasing or renting products or equipment, participating in a promotion or programme, or otherwise using our services, you agree to these Terms.

1. Our Services

Sleeping Lab provides sleep-health related products and services which may include:

• sleep-health consultations and assessments;
• home sleep testing;
• sleep-apnea screening and assessment support;
• CPAP consultation, fitting, trial, rental and/or sale;
• therapy support and follow-up services;
• sleep-related products, equipment and accessories; and
• other related products and services that may be offered from time to time.

The availability, scope, pricing and eligibility requirements of individual products and services may vary.

2. Health and Medical Information

Information provided on the Website or through Sleeping Lab’s educational materials is intended for general informational and educational purposes only.

Such information should not be considered a substitute for professional medical advice, diagnosis or treatment.

Any questionnaire, screening assessment, sleep test or other tool provided by Sleeping Lab is intended to support the assessment of potential sleep-related conditions and does not, by itself, constitute a medical diagnosis.

Where appropriate, customers should consult a suitably qualified healthcare professional regarding their symptoms, diagnosis and treatment.

If you experience severe, urgent or potentially life-threatening symptoms, you should seek immediate medical attention.

3. Appointments

All appointments are subject to availability and confirmation.

You are responsible for providing accurate, complete and up-to-date information relevant to your appointment, assessment or service.

If you are unable to attend an appointment, you should notify Sleeping Lab as soon as reasonably possible.

Sleeping Lab reserves the right to reschedule or cancel an appointment where reasonably necessary, including due to staff availability, equipment availability, operational requirements, safety concerns or circumstances beyond our reasonable control.

4. Sleep Tests and Assessments

Home sleep tests and other assessments should be carried out in accordance with the instructions provided by Sleeping Lab.

Test results may be affected by factors including:

• incorrect use or positioning of equipment;
• inadequate recording time;
• equipment malfunction;
• interrupted sleep;
• environmental factors; or
• other circumstances beyond Sleeping Lab’s reasonable control.

Where a test is incomplete or inconclusive, Sleeping Lab may recommend a repeat assessment or further consultation with an appropriate healthcare professional.

Sleep test results should be interpreted together with relevant symptoms, health history and other clinical information.

5. CPAP and Related Products

Where CPAP therapy or another product or service is recommended, individual experiences and outcomes may vary.

Customers should use CPAP equipment and related products in accordance with the instructions provided by Sleeping Lab, the product manufacturer and, where applicable, the relevant healthcare professional.

Manufacturer warranties remain subject to the applicable manufacturer’s warranty terms.

Returns or exchanges involving consumable, opened or hygiene-sensitive products may be restricted where permitted by applicable law.

Nothing in these Terms excludes or limits any statutory consumer rights that cannot legally be excluded.

6. Prices and Payment

Prices, fees, deposits and other charges applicable to Sleeping Lab products and services will be communicated before or at the time of booking, purchase or rental.

You are responsible for ensuring that all payment information provided is accurate and that you are authorised to use the relevant payment method.

Additional terms may apply to:

• product rentals;
• trials;
• deposits;
• instalment arrangements;
• packages; or
• third-party payment or financing arrangements.

7. Cancellations, Returns and Refunds

Eligibility for cancellations, refunds, returns or exchanges may depend on:

To the maximum extent permitted by applicable law, Sleeping Lab and Listening Lab Sdn Bhd will not be responsible for indirect, incidental, special or consequential loss arising solely from the use of the Website.
